Terms of Service

1. About these terms

These terms apply to your use of the Trackday platform at trackday.com.au, the Trackday mobile app (com.trackday.mobile), the Marshal cryptographic companion app (com.trackday.marshal), and any associated services we operate (collectively, the "Service").

The Service is operated by Trackday Pty Ltd, an Australian company registered in Victoria. By creating an account or using the Service, you agree to these terms. If you don't agree, please don't use the Service.

2. Your account

You must:

  • Be 16 years or older
  • Provide accurate registration information and keep it up to date
  • Keep your sign-in credentials and Marshal device secure
  • Not share your account, transfer it, or use someone else's account

You're responsible for activity on your account, including any documents you sign via Marshal. If you suspect unauthorised access, contact [email protected] immediately.

3. Acceptable use

You agree NOT to:

  • Use the Service for unlawful purposes or in breach of any applicable law
  • Harass, defame, threaten, or harm other users
  • Post content that infringes copyright, trademark, or other IP rights
  • Attempt to gain unauthorised access to the Service or other users' accounts
  • Reverse-engineer, decompile, or otherwise probe the Marshal cryptographic surface
  • Use automated means (bots, scrapers) to access the Service without our written consent
  • Send spam, unsolicited messages, or fraudulent signing requests via Marshal

We reserve the right to suspend or terminate accounts that breach these rules. Marshal attestations remain cryptographically valid even after account suspension. The audit trail is permanent.

4. Marshal: cryptographic signing

The Marshal app is a cryptographic companion that lets you sign documents using a key pair generated and stored in your device's Secure Enclave (iOS) or StrongBox (Android).

Important: signatures produced by Marshal are legally binding under the Electronic Transactions Act 1999 (Cth) and equivalent state legislation. Don't sign documents you don't understand. We are not a party to documents you sign. The legal effect runs between you and the document's sender.

You acknowledge:

  • Your private keys never leave your device. We can't recover them if you lose access to your device.
  • Trackday provides counter-signature timestamping via OpenBao Transit. We do NOT sign documents on your behalf. We attest that a document was signed at a specific time.
  • Document plaintext is never sent to our servers. Only encrypted ciphertext transits via our Redis relay (7 days for free users, 30 days for premium).

5. Premium subscriptions

Marshal premium features are sold via Apple In-App Purchase (iOS) and the Google Play Billing system (Android). Pricing is set in the App Store / Play Store and shown to you before purchase.

Subscriptions auto-renew unless you cancel at least 24 hours before the end of the current period. Manage subscriptions in your iPhone Settings → Apple ID → Subscriptions (iOS) or Google Play → Subscriptions (Android).

If you cancel, you keep premium access until the end of the current billing period. We don't offer pro-rated refunds for partial periods. Refund requests are handled through Apple or Google's standard refund process.

6. Australian Consumer Law

Our goods and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. You're entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage.

You're also entitled to have services repaired or resupplied if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts, or modifies any guarantee, condition, warranty, right, or remedy under the Competition and Consumer Act 2010 (Cth) or any other applicable law where to do so would be unlawful.

7. Liability

To the extent permitted by law, our liability for any claim arising out of or in connection with the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) AU$100.

We're not liable for indirect, incidental, special, or consequential losses, including lost profits, lost data, or business interruption.

We don't exclude liability for fraud, gross negligence, or anything we can't lawfully exclude under Australian Consumer Law.

8. Termination

You can delete your account at any time via Settings → Account → Delete account. We may terminate or suspend your account if you breach these terms or if we're required to do so by law.

Cryptographic attestations created via Marshal before termination remain valid and replayable from the public audit chain. Termination doesn't void documents you previously signed.

9. Privacy

Our handling of your personal information is governed by our Privacy Policy.

10. Changes

We may update these terms from time to time. Material changes are posted here at least 30 days before they take effect, and active users get email or in-app notice. Continued use after the effective date constitutes acceptance.

11. Governing law

These terms are governed by the laws of Victoria, Australia. Disputes are heard in the courts of Victoria.
